Welcome to Überpack.

These Terms of Service ("Terms") govern your access to and use of the Überpack website, including www.myuberpack.com, and your purchase of products from us.

The website and the products and services offered through it are operated by KALLISTO TECHPACKS PRIVATE LIMITED, under the consumer brand Überpack ("Überpack", "we", "us" or "our").

By accessing our website, browsing our products or placing an order, you agree to these Terms and the policies referenced in them, including our Return & Refund Policy, Privacy Policy and Shipping Policy.

If you do not agree with these Terms, please do not use the website or purchase products from us.

2. ELIGIBILITY

You must be legally capable of entering into a contract under applicable law to purchase products from our website.

By placing an order, you confirm that the information you provide to us is accurate and complete.

3. PRODUCTS AND PRODUCT INFORMATION

We make reasonable efforts to display our products, colours, materials, dimensions and other product information as accurately as possible.

Actual colours may vary slightly depending on your device, screen settings and other technical factors.

Product photographs may also contain styling or display elements that are not included with the product unless specifically stated.

Product availability may change from time to time. We reserve the right to discontinue products or limit quantities where reasonably necessary.

4. ORDERS

When you place an order through our website, you are submitting a request to purchase the selected products.

After placing an order, you will receive an order confirmation containing the relevant order details.

An order may be cancelled or declined in limited circumstances, including where a product is unavailable, there is an obvious pricing or listing error, payment cannot be successfully processed, or we reasonably suspect fraudulent or unauthorised activity.

If we cancel an order after payment has been received, we will initiate an appropriate refund to the original payment method, subject to applicable law.

5. PRICES, TAXES AND PAYMENTS

All product prices displayed on our website are in Indian Rupees (INR).

Applicable taxes and shipping charges, if any, will be displayed during the purchase process as applicable.

We currently accept prepaid online payments through the payment methods made available at checkout.

We do not currently offer Cash on Delivery (COD).

Payment transactions are processed through our payment service providers. We do not directly store your complete card or other sensitive payment credentials.

You agree to provide accurate and complete billing and payment information.

6. PROMOTIONS AND DISCOUNTS

From time to time, Überpack may offer promotional campaigns, discounts or complimentary products.

Each promotion may have specific eligibility conditions, validity periods and usage limits.

Unless expressly stated otherwise, promotions cannot be combined with other promotional offers or discounts.

For the "First 20 Orders" promotional offer, eligible customers who purchase a qualifying Überpack Backpack or Duffle Bag may receive one eligible Waist Pouch free of charge, subject to the promotional terms displayed on the website.

The complimentary product is subject to availability and the stated maximum number of promotional redemptions.

If a qualifying order is returned, any complimentary promotional product received as part of that order must also be returned in accordance with our Return & Refund Policy.

7. SHIPPING AND DELIVERY

We currently deliver orders through third-party courier and logistics service providers.

Shipping charges and applicable delivery information will be displayed during checkout.

Delivery timelines are estimates and may vary depending on the destination, courier service, weather, public holidays, operational disruptions and other circumstances beyond our reasonable control.

We will make reasonable efforts to dispatch orders within the timeframe communicated to you.

Once an order has been handed over to the courier or logistics provider, delivery is subject to the courier's operations and service conditions.

If an order is delayed, lost or damaged in transit, please contact us at customercare@myuberpack.com or shah2913@myuberpack.com and we will work with the relevant logistics provider to resolve the issue.

8. RETURNS, REFUNDS AND EXCHANGES

Our Return & Refund Policy governs returns, refunds, damaged products, defective products and exchanges.

We currently offer a 7-day return window from the date you receive your order, subject to the conditions specified in that policy.

For eligible change-of-mind returns, the customer is responsible for the return shipping cost.

For products that are defective, damaged in transit, incorrectly delivered or materially different from what was ordered or advertised, Überpack will handle the return shipping in accordance with our Return & Refund Policy and applicable law.

9. CANCELLATION OF ORDERS

If you wish to cancel an order, please contact us as soon as possible at customercare@myuberpack.com.

We will make reasonable efforts to accommodate cancellation requests received before the order has been processed or shipped.

Once an order has been shipped, cancellation may no longer be possible and the applicable return process may apply.

Nothing in this section limits any cancellation or consumer rights available to you under applicable law.

10. INTELLECTUAL PROPERTY

All content on the Überpack website, including but not limited to the Überpack name, logo, brand identity, product names, designs, photographs, graphics, illustrations, written content, videos, text, artwork and other materials, is owned by or licensed to KALLISTO TECHPACKS PRIVATE LIMITED or Überpack, unless otherwise stated.

You may access and use the website for personal, non-commercial purposes.

You may not reproduce, copy, modify, distribute, publish, sell, commercially exploit or otherwise use Überpack's intellectual property without our prior written permission, except where permitted by applicable law.

11. WEBSITE USE

You agree not to misuse our website or attempt to interfere with its operation.

You must not use the website for unlawful purposes, attempt to gain unauthorised access to our systems, introduce malicious code, interfere with security features, or engage in activity that could damage the website, our business or other users.

We will not be responsible for delays or failure to perform our obligations where such delay or failure results from circumstances beyond our reasonable control, including natural disasters, extreme weather, government actions, strikes, transportation disruptions, technical failures, public emergencies or other similar events.

18. FEEDBACK

If you voluntarily provide feedback, suggestions, photographs, reviews or other content to Überpack, you confirm that you have the right to provide that content.

We may use genuine customer feedback for improving our products and services and, with appropriate permission where required, for marketing or promotional purposes.

We will not knowingly represent fabricated or non-genuine feedback as customer feedback.

We may update these Terms from time to time to reflect changes to our business, website, products, services or applicable requirements.

Your continued use of the website after an updated version is published constitutes acceptance of the updated Terms to the extent permitted by applicable law.

Subject to applicable consumer protection laws and the jurisdiction available to a consumer under applicable law, disputes relating to these Terms or purchases from Überpack will be subject to the jurisdiction of the competent courts in Mumbai, Maharashtra.

Nothing in these Terms is intended to take away or restrict any rights or remedies available to consumers under applicable law.
